Terms of Use

Draft terms governing access to and use of SoundSend.

Draft status and agreement

These draft terms are intended to govern use of SoundSend, provided by Christian Tadros. They require professional legal review and alignment with the production app before launch. By using the released service after final terms are posted, a user would agree to those final terms.

Eligibility and accounts

You must be at least 13 years old to use SoundSend. Users must provide accurate account information, keep credentials secure, and notify SoundSend of suspected unauthorized account access.

Some local playback features may work without an account. Uploads, synchronization, public publishing, or other cloud-backed features may require authentication.

The SoundSend service

SoundSend supports organizing and playing short sounds, installing official SoundPacks, maintaining a unified SoundLibrary, importing personal audio, creating SoundBoards, and sharing supported audio through Apple Messages. Features may change, and community discovery or publishing may be unavailable or marked as in development.

Your content and responsibility

You retain ownership of audio and other content you upload, subject to rights held by other people. You are responsible for ensuring that you have the permissions necessary to upload, store, organize, send, or publish that content.

You must not upload or share content that infringes copyright, privacy, publicity, trademark, or other rights, or that violates law or SoundSend policies.

License needed to operate the service

You grant SoundSend a limited, non-exclusive license to host, store, copy, transcode, cache, and deliver your content only as reasonably necessary to operate the features you request. For private content, that license is limited to private storage, processing, and user-directed delivery.

If you deliberately publish content to a future community area, the final terms must define the additional license needed to display, distribute, moderate, and let other users save or add that public content to SoundBoards. Public-license language must be reviewed before community launch.

Official content and SoundPacks

SoundSend and its licensors retain rights in the app, official SoundPacks, branding, software, and service content. Installation or playback does not transfer ownership. Any restrictions on extracting or redistributing official sounds must be finalized with the underlying content rights.

Messages and recipients

You choose whether to send a SoundSend Player message or Universal Audio where available. You are responsible for the recipient and the content you send. Delivery may depend on Apple services, network availability, recipient software, hosted-content availability, and other factors outside SoundSend’s control.

Acceptable use

Use of SoundSend is subject to the Acceptable Use Policy and, for public content, the Community Guidelines. Prohibited conduct includes infringement, unlawful or abusive content, malicious activity, attempts to bypass security or access controls, automated scraping, service disruption, and impersonation.

Moderation, removal, and suspension

SoundSend may investigate reports and may limit distribution, remove content, restrict features, suspend accounts, or terminate access when reasonably necessary to address policy violations, legal risk, security, or service integrity. The final policy should describe any available appeal process without promising a process that is not operational.

Copyright complaints

Reports of allegedly infringing community content should follow the Copyright and User-Upload Policy. SoundSend has not represented that a formal designated-agent or counter-notice process is configured until those launch steps are completed.

Third-party services

SoundSend may rely on Apple, Supabase, hosting, analytics, diagnostics, and other service providers. Third-party services are governed by their own terms. SoundSend is not responsible for third-party services to the extent permitted by applicable law.

Disclaimers and limitation of liability

Any warranty disclaimer, limitation of liability, indemnity, and consumer-rights language must be drafted for the chosen legal entity, jurisdiction, and markets. These provisions are intentionally not finalized in this draft.

Changes and termination

SoundSend may update the service and final terms. The published terms should explain notice and effective-date practices. Users may stop using SoundSend and request account deletion through the verified process. Terms that by their nature should survive termination may continue to apply.

Governing law and disputes

These terms are intended to be governed by the laws applicable in Florida, United States. The final governing-law and dispute provisions require legal review before publication and must preserve rights that cannot be waived under applicable consumer law.
